1. How We Rank Offers

The search results you see on our platform are not random. To help you find the perfect accommodation, we rank listings based on a combination of factors. The main parameters that determine the ranking are:

  • Search Relevance: How well the listing matches your search criteria (e.g., dates, location, number of guests).
  • Listing Popularity: Based on factors like the number of views, booking requests, and positive reviews.
  • Listing Quality: The completeness and quality of the information provided by the owner, including photos, detailed descriptions, and response rate.

Special Promotions: Listings with special offers or discounts may be highlighted.

2. Information About the Property Owner

On each listing, we clearly indicate whether the property owner is acting as a business (or professional) or as a private individual. This distinction is important for you:

  • If the Owner is a Business/Professional: Your booking is fully covered by Spanish and European consumer protection regulations.
  • If the Owner is a Private Individual: The rental relationship is governed by civil law (specifically, the Urban Leases Act), and consumer protection regulations do not apply to the rental agreement itself.

3. Distribution of Contractual Obligations

It is essential to understand the roles and responsibilities of each party involved in a booking:

The Property Owner is responsible for:

  • Ensuring the information in their listing (description, price, availability, rules) is truthful, complete, and legally compliant.
  • Holding and displaying a valid accommodation registration number in accordance with all applicable local, regional, and national regulations.
  • Fulfilling the agreed booking conditions (e.g., providing the accommodation as described).
  • Managing any incidents related to the property directly with the user.

The User (You) is responsible for:

  • Providing truthful information during the booking process.
  • Complying with the payment terms and the house rules set by the owner.
  • Respecting the accommodation and its facilities.

MidStay-canary.com is responsible for:

  • Providing a functional and secure platform for searching, booking, and paying.
  • Performing verifications of accommodation registration numbers as required by current regulations (Real Decreto 1312/2024, de 23 de diciembre).
  • Facilitating communication between the owner and the user through our messaging tools.
  • Acting with due diligence to remove unlawful content when we have effective knowledge of it.
  • Providing you with the mandatory pre-contractual information contained in this section.

4. General Service Information

  • Main Characteristics of the Service: An online platform that allows users to find, book, and pay for seasonal accommodation stays offered by property owners.
  • Price: The total price of the reservation, including our platform commission and any other applicable fees, will be clearly displayed and itemised before you confirm your booking.
  • Booking and Payment Process: The entire process is conducted online. To complete a booking, you must accept our Terms & Conditions, Privacy Policy, and the specific Cancellation Policy applicable to the booking.
  • Contractual Documents: The legal relationship is governed by the documents mentioned above, which are available for review at any time on our website.
  • Right of Withdrawal: In accordance with Article 103(l) of the Royal Legislative Decree 1/2007, the right of withdrawal does not apply to accommodation reservation contracts for a specific date or period of performance.
