1. About MidStay-canary.com

MidStay-canary.com is an online platform operated by MAJA Living SL, based in Spain and operating in the Canary Islands. Our platform provides a digital marketplace that allows property owners (“Owners”) and tenants (“Users”) to connect and arrange medium-term accommodation stays.

MidStay-canary.com acts solely as a technology intermediary. Our role is limited to:

  • Publishing property listings created by Owners.
  • Allowing Users to search for properties and request bookings.
  • Facilitating online payments for bookings.
  • Providing basic tools for communication between Owners and Users.

MAJA Living SL does not own, manage, or provide accommodation itself. We are not a real estate agency, a landlord, or a party to any rental agreement.

2. Rental Agreements

Any rental agreement is made directly and exclusively between the Owner and the User. MidStay-canary.com is not a party to these agreements and, as such, does not enforce rental contracts or guarantee that a stay will meet a User’s expectations.

3. Property Listings: Owner's Responsibility and Platform's Diligence

All information displayed in property listings (such as descriptions, prices, availability, and house rules) is provided solely by the Owners. The Owner is exclusively responsible for ensuring this information is complete, accurate, and compliant with all applicable laws and regulations.

However, in compliance with our legal obligations as an online platform, particularly those established by Spanish law for short-term rental intermediaries, MidStay-canary.com performs checks to verify the validity of the accommodation registration numbers provided by Owners. This verification is conducted to ensure the reliability of the platform but does not transfer the Owner’s primary legal responsibility for the listing’s overall compliance to MAJA Living SL.

4. Limitation of Liability

As a technology intermediary service, and to the maximum extent permitted by law, MAJA Living SL shall not be liable for issues arising directly from the relationship between Owners and Users, including but not limited to:

  • The condition, safety, or legality of the properties.
  • The accuracy or legality of the content in the listings.
  • Personal injuries, losses, or damages occurring during a stay.
  • The actions or omissions of any Owner or User.

Our responsibility is limited to our role as an intermediary. We act with due diligence and will take appropriate action to remove any listing or content that is proven to be illicit or non-compliant upon receiving effective knowledge of it, in accordance with applicable law.

5. Pre-contractual Information for Consumers

To ensure full transparency before you make a booking, we provide essential information in compliance with consumer protection regulations. This includes details on how search results are ranked and the legal status of the Owner (whether they are a professional or a private individual). 6. Governing Law

This Legal Disclaimer and the use of the MidStay-canary.com platform are governed by Spanish law, with jurisdiction in the courts of the Canary Islands.
