Terms and Conditions

1. Introduction

These Terms & Conditions govern the access to and use of the MidStay-canary.com platform (the “Platform”).

The Platform is operated by MAJA Living SL, a company registered in Spain, operating primarily in the Canary Islands (“MidStay”, “we”, “us”).

By accessing or using the Platform, you agree to be bound by these Terms & Conditions.

2. Role of the Platform

MidStay-canary.com operates as an online marketplace and intermediary.

  • MidStay-canary.com is not a property owner, not a landlord, and not a real estate agency.
  • MidStay-canary.com does not provide accommodation.
  • Rental agreements are entered into directly between the property owner and the tenant.

MidStay-canary.com’s role is limited to:

  • publishing property listings,
  • facilitating booking requests,
  • enabling online payments,
  • providing basic communication tools.

3. User Accounts

Users may register as:

  • Property Owners
  • Tenants

Users are responsible for:

  • providing accurate and up-to-date information,
  • safeguarding their login credentials,
  • all activity carried out under their account.

4. Property Listings

Property owners are solely responsible for:

  • the accuracy and completeness of listings,
  • pricing, availability, and house rules,
  • compliance with applicable laws and regulations.

MidStay-canary.com reserves the right to:

  • review listings before publication,
  • edit, suspend, or remove listings at its discretion.

5. Bookings

A booking is created when:

  • a tenant submits a booking request, and
  • payment is successfully completed through the Platform.

MidStay-canary.com does not guarantee:

  • the condition of properties,
  • uninterrupted availability,
  • the conduct of users.

6. Payments & Commission

Payments are processed through the Platform.

  • Payments are received by MAJA Living SL.
  • MidStay-canary.com deducts a commission for platform services.
  • The remaining amount is paid to the property owner separately.

MidStay-canary.com is not responsible for disputes arising from the stay itself.

7. Security Deposits

Security deposits, if applicable:

  • are defined by the property owner,
  • are communicated before booking confirmation,
  • may be handled manually and outside automated escrow systems.

8. Cancellations

Cancellation conditions are governed by the Cancellation Policy and apply to all bookings.

MidStay-canary.com may assist administratively but does not determine refund eligibility beyond the published policy.

9. Messaging

The Platform provides messaging tools to facilitate communication between owners and tenants.

MidStay-canary.com:

  • does not monitor conversations in real time,
  • does not guarantee message delivery,
  • may access messages only for operational or legal reasons.

10. Limitation of Liability

To the maximum extent permitted by law, MidStay-canary.com shall not be liable for:

  • property conditions,
  • personal injury or loss,
  • disputes between users,
  • indirect or consequential damages.

11. Governing Law & Jurisdiction

These Terms are governed by Spanish law. Any disputes shall be subject to the jurisdiction of the courts of the Canary Islands.
